These terms govern the use of the WaySplat website (https://waysplat.com), WaySplat visitor pages (https://go.waysplat.com) and WaySplat Immo property tours (https://immo.waysplat.com). Using any of these services means you accept these terms. WaySplat’s business customers are also bound by the Terms of service for business customers and their contract.
1. Who does what
- WaySplat (Marvin De Souza, see the Legal notice) designs and runs the technology: the photoreal 3D world, search and guidance.
- The venue operator (airport, mall, hospital, stadium, store…) or the property advertiser (agency, developer, private seller) is WaySplat’s customer. It makes the service available to its visitors and provides the content: places and services, opening hours, flights, seats, offers, contact details.
- You, the visitor, use the service for free, without an account.
Venue-specific information (a store name, opening hours, a boarding gate, a hospital department, an offer…) is the operator’s responsibility. If you spot an error, report it to the operator or to [email protected]: we will pass it on.
2. Your safety first
WaySplat guidance is a wayfinding aid. It does not replace your attention, official signage or staff instructions.
- Watch where you walk. Look up from the screen on stairs, escalators and moving walkways, at crossings, in car parks and wherever vehicles move.
- Do not use the service while driving a vehicle, riding a bike or a scooter.
- In an emergency or alarm, follow evacuation signs and staff instructions, never the screen. WaySplat is not an evacuation or safety system.
- Life-threatening emergency: call 112 (European emergency number) or your local emergency number. In a hospital, the page gives no medical advice and does not replace reception or caregivers.
- Accessibility: step-free routes are indicative. A lift may be out of order or reserved; if in doubt, ask staff.
3. What the service can and cannot guarantee
- Your position is approximate. Depending on the venue and the device, it comes from GPS, your phone’s sensors or Bluetooth beacons, with an accuracy of a few metres. Indoors without beacons, GPS may be missing or wrong.
- The 3D world shows the venue as it was when it was scanned. Works, refurbishments, moved stores or services may not appear yet.
- Flights, times and gates: official information (airport screens, boarding pass, announcements, airline) always prevails. Displayed walking times are estimates. WaySplat cannot be held liable for a missed flight, appointment or event.
- Availability: we do our best to keep the service running continuously, without being able to guarantee it (saturated mobile network, maintenance, provider outage).
- Mobile data: the first time a venue loads, its 3D model is downloaded, from a few tens to several hundred megabytes depending on its size. Prefer the venue’s Wi-Fi if available. The model is then kept on your device.
4. Property tours (WaySplat Immo)
- The virtual tour shows the property as it was on the day of the scan; it has no contractual value. The actual condition, fittings and furniture may differ.
- Measurements taken with the Measure tool are indicative. They replace neither legal floor-area measurements (such as the French “loi Carrez” or “loi Boutin” areas), nor mandatory surveys, nor a surveyor’s report, and cannot support any claim.
- WaySplat is not a party to the sale or rental. Questions about the property, price, physical viewings and the transaction are for the agency or seller, whose contact details appear in the tour.
5. Intellectual property
- The website, software, rendering and guidance engine, interfaces, texts, visuals and the WaySplat brand are protected and belong to their owner.
- The 3D models, images and content of a venue or property belong to the operator or advertiser, and to the rights holders appearing in them (architecture, artworks, signs, trademarks, logos). Displaying them in WaySplat transfers no rights to you.
- Trademarks mentioned on the website (for example in search examples) belong to their owners. Stores, products and flights shown in mock-ups are fictitious.
- Open-source components used by WaySplat are listed under Licenses and credits.
6. What is prohibited
You agree not to:
- download, extract, copy, convert or reuse a 3D model, image or venue content outside normal use of the service;
- scrape the website or the service by automated means (bots, scripts), except indexing by search engines;
- use the content to train or feed an artificial intelligence system: WaySplat and its customers expressly reserve their rights and opt out of text and data mining of venue and property content (3D models, images, place lists) (Article 4 of Directive (EU) 2019/790 and Article L. 122-5-3 of the French Intellectual Property Code); this reservation is also expressed in machine-readable form on visitor pages and tours;
- decompile or disassemble WaySplat’s code or formats, or try to reconstruct them, except where permitted by law;
- bypass protections, disrupt, overload or attempt to break into the service or its infrastructure;
- use the service or its content to prepare or facilitate an unlawful act, in particular any attack on the safety of a venue, its occupants or its facilities;
- present the service or its content as your own, or embed it in another website or app without the written consent of WaySplat and the venue operator.
In case of breach, WaySplat may block the access concerned, without prejudice to any other action.
7. Links and embeds
The service may link to third-party sites (an agency’s website, a maps app, an airline). WaySplat does not control their content. A property tour may be embedded by the advertiser in its own website, under the advertiser’s responsibility.
8. Liability
The service is provided free of charge to visitors. To the extent permitted by law, WaySplat is not liable for indirect damage arising from its use (delay, missed opportunity, loss of data on the device). Nothing in these terms limits your protection where the law forbids it, in particular in case of gross negligence or personal injury.
9. Personal data
See the Privacy policy and Bluetooth, location and sensors.
10. Changes, governing law
WaySplat may change the service and these terms; the version in force is the one published on this page, dated at the top. These terms are governed by French law. If you are a consumer, you keep the protection of the mandatory rules of your country of residence and may bring a claim before the court competent under applicable law. The French version prevails in case of discrepancy. Contact: [email protected].
